Terms & Conditions

Effective Date: 3rd September 2026

These Terms & Conditions ("Terms") set out the agreement between LifeCoaching by Design ("we", "us", "our") and you, the Client engaging our services (“you”, “your”).

By using our website, booking a service, making a payment, accessing or downloading any resources or participating in our services, you confirm you have read, understood and agree to be bound by these Terms.

1. Services Provided

We provide professional Life & Wellness Coaching and related services, including, but not limited to:

- One-to-one coaching (online or in person, where specified)

- Coaching programs, workshops and events

- Online courses and programs

- Supporting resources, guides and workbooks; 

A free Discovery Call is an opportunity to discuss your circumstances and determine whether coaching may be appropriate for you. A Discovery Call does not create a coaching relationship or obligation to purchase services.

2. Coaching Disclaimer

The International Coaching Federation (ICF) defines coaching as "partnering with clients in a thought-provoking and creative process that inspires them to maximize their personal and professional potential.”

Our coaching philosophy is aligned to the ICF philosophy and our coaching services are designed to support you with self-reflection and increased self-awareness, identifying priorities and creating goals, taking accountability, decision-making and creating action plans, and making mindset and behavioural change.  

You understand that successful coaching requires a co-active collaborative approach i.e. In the coaching relationship, we play the role of a facilitator of change, but it is your responsibility to enact or bring about the change.

You acknowledge that coaching outcomes depend on your participation and circumstances, and that we cannot guarantee any particular personal, professional, health or life outcome.

Coaching should never be considered a substitute for medical, psychological or other healthcare advice, nor is it to be used as a substitute for professional advice by legal, financial, business or other qualified professionals. If appropriate, you should seek independent professional guidance in these areas, and understand that all decisions and actions in these areas are your full responsibility.

Although I have a medical background, I am acting solely in my capacity as a Professional Coach when providing coaching services. I do not provide medical advice, diagnosis, treatment, referral to healthcare professionals, nor prescribe or recommend medication or other medical treatment.

Information shared through our website, resources or coaching services is not a substitute for advice from a suitably qualified healthcare or other professional. Our coaching services are not intended to replace services provided by your doctor, psychologist, psychiatrist, counsellor, dietitian, physiotherapist or other healthcare professional.

You remain responsible for your own health, wellbeing, decisions and actions.

If you have a medical, psychological or other health concern, or are experiencing symptoms that require professional assessment or treatment, you should consult an appropriately qualified healthcare professional.

Emergency services: Coaching is not an emergency or crisis service. If you are experiencing an emergency or believe that you or another person is at immediate risk of harm, you should contact the appropriate emergency or crisis service rather than contacting us for assistance.

3. Booking and Payment

Details of the applicable service, program, price and payment arrangements will be provided at the time of booking.

Unless otherwise agreed, services are payable in full before the relevant service or program commences to confirm your booking.

We accept payment by bank transfer or through our nominated payment provider, which may include Stripe.

All prices are in Australian dollars and include GST where applicable.

Where a payment plan has been agreed, you remain responsible for making each payment by the agreed due date. We reserve the right to suspend or cancel access to services where agreed payments are not received.

4. Cancellation, Rescheduling and Refunds

We understand that circumstances can change.

You may cancel or reschedule a coaching session by providing at least 24 hours' notice.

Where less than 24 hours' notice is provided, or you do not attend a scheduled session (“no show”), we may charge a cancellation fee of up to 50% of the applicable session fee, unless we agree otherwise in the circumstances.

We do not generally provide refunds for change of mind once a service has commenced.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

Where we are unable to provide an agreed service due to circumstances within our reasonable control, we will work with you to reschedule the service or, where appropriate, provide a refund.

5. Client Responsibilities

Coaching is a collaborative process. To support a productive coaching relationship, you agree to:

- Participate openly and respectfully

- Take responsibility for your own decisions, actions and outcomes

- Engage with agreed reflection or preparation activities where appropriate

- Communicate any concerns that may affect your participation

- Attend scheduled sessions on time

- Provide a suitable environment for online sessions; and

- Seek appropriate professional support where your circumstances require it.

6. Confidentiality 

We respect your privacy and will keep confidential all information you share with us during the course of our services, except where:

- You give consent for disclosure

- Disclosure is required or authorised by law; or

- There is a serious and immediate risk of harm to you or another person.

Where coaching is delivered in a group setting, we ask and expect all participants to respect the confidentiality of others. However, we cannot guarantee the actions of other participants and we are not liable for privacy breaches, confidentiality violations, or information sharing between members.

7. Privacy and Data Protection

We are committed to protecting your privacy and handling your personal information responsibly.

We collect, use, store and disclose personal information in accordance with the Privacy Act 1988 (Cth), applicable Australian privacy laws and our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and disclose personal information and how you can access or correct information we hold about you.

We use third-party service providers including, but not limited to Vayia (on GoHighLevel  infrastucture), Google Workspace, Stripe to deliver services. By using our services, you acknowledge that your information may be processed by these platforms in accordance with their respective privacy policies.

8. Intellectual Property

All content and materials we provide (“Materials”) remain our intellectual property unless otherwise stated. This includes our:

- Coaching frameworks and methodologies

- Workbooks, guides, templates, exercises and coaching tools

- Online course content, videos and other educational resources

- Website content

- Graphics, branding and logos

- Other original materials

When you purchase a service or resource, you receive a personal, non-exclusive, non-transferable licence to use the materials for your own personal learning and development.

You may download, print and annotate materials provided to you for your personal use.

You must not, without our written permission:

- Reproduce or distribute our materials to others

- Share or publish them online

- Sell or commercially exploit them

- Use them to provide coaching, training or other professional services

- Create competing programs or resources from them 

- Remove copyright or branding notices.

9. Use of Artificial Intelligence

Our coaching materials, frameworks and resources are our intellectual property.

Without our written permission, you must not upload our proprietary materials into artificial intelligence systems or language models for the purpose of reproducing, redistributing or commercially exploiting them.

You may use AI tools with your own personal notes or reflections, provided this does not involve sharing our confidential or proprietary materials in breach of these Terms.

We will handle your personal information in accordance with our Privacy Policy.

10. Online Services and Third-Party Platforms

Our services are delivered via third-party platforms for the purposes of website and email hosting, online video conferencing, scheduling appointments, payment processing and cloud storage services. These platforms include, but are not limited to Vayia (on GoHighLevel infrastructure), Google Workspace and Stripe. 

We take reasonable care in selecting service providers but we are not responsible for and accept no liability for:

- Platform outages, downtime, technical failures, or security breaches

- Loss of access due to the Client's internet connection, device compatibility, software issues, or user error

- Third-party changes to platform terms, pricing, functionality, or availability

- Data loss or corruption caused by third-party platform failures

- Your use of third-party platforms may also be subject to their own terms and privacy policies.

We may provide links to third-party websites or resources for your convenience. We are not responsible for their content, availability or privacy practices.

11. Website Content

We take reasonable care to ensure that information published on our website is accurate and current. However, website content is provided for general informational and educational purposes and may change from time to time.

Nothing on this website constitutes medical, psychological, legal, financial or other professional advice.

Accessing our website, downloading a free resource, subscribing to our mailing list or making an enquiry does not create a coach-client relationship.

A coaching relationship begins only when you have agreed to engage our services and any applicable payment arrangements have been completed.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where the law implies a guarantee, warranty or condition that cannot legally be excluded, our liability is limited to the maximum extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, our liability arising from or in connection with our services or this website is limited to the amount paid by you for the relevant service.

We are not liable for any loss, damage, injury or claim arising from or in connection with your participation in our services or use of this website, except to the extent that such liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes, restricts or modifies any rights or liability that cannot legally be excluded or limited under applicable law.

You acknowledge that coaching is a collaborative process and that you remain responsible for your own decisions, actions and outcomes.

14. Force Majeure

We will not be responsible for delay or failure to provide services where this results from circumstances beyond our reasonable control, including serious illness, natural disasters, power or internet outages, government restrictions, pandemics or other unforeseen events.

Where reasonably possible, we will work with you to reschedule affected services.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any dispute arising in connection with these Terms or your use of our website will be subject to the jurisdiction of the courts of Victoria, subject to any rights you may have under applicable Australian law.

16. Amendments

We may update these Terms from time to time to reflect changes to our business, services, technology or legal obligations. The most current version will be published on our website and will apply from the date it is published.

17. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

These Terms, together with our Privacy Policy and any specific terms provided to you when purchasing a service, form the agreement governing your use of our website and services.
